ประสิทธิผลของการเรียกค่าเสียหายเบื้องต้นตามสิทธิ ภายใต้การคุ้มครองของพระราชบัญญัติคุ้มครองผู้ประสบภัยจากรถของโรงพยาบาลตำรวจ

Abstract

การศึกษาวิจัยครั้งนี้ มีวัตถุประสงค์สองประการ คือ ประการแรก เพื่อค้นหาประสิทธิผลของการเรียกค่าเสียหายเบื้องต้นตามสิทธิ ภายใต้การคุ้มครองของ พ.ร.บ.คุ้มครองผู้ประสบภัยจากรถของโรงพพยาบาลตำรวจ ในกรณีที่ผู้ประสบภัยมอบอำนาจให้โรงพยาบาลตำรวจ เป็นผู้จัดเก็บค่าเสียหายเบื้องต้นแทนตน ประการที่สอง เพื่อค้นหาแนวทางในการปรับปุรง และพัฒนาระบบการเรียกค่าเสียหายเบื้องต้น ภายใต้การคุ้มครองของ พ.ร.บ.คุ้มครองผู้ประสบภัยจากรถให้เกิดประสิทธิผลมากยิ่งขึ้น /ผู้ศึกษาได้กำหนดขอบเขตการศึกษาไว้ 2 ด้าน คือ ศึกษาจากเอกสาร (Document) เพื่อให้ทราบถึงความสัมพันธ์ของระบบย่อย ภายในระบบการเรียกเก็บค่าเสียหายเบื้องต้นตามสิทธิฯ ซึ่งจะมีผลต่อความสำเร็จหรือไม่สำเร็จ ในการเรียกเก็บค่าเสียหายเบื้องต้นของโรงพยาบาลตำรวจ และศึกษาจากระบบ (System) โดยการใช้แบบสอบถาม เฉพาะกับเจ้าหน้าที่ผู้เกี่ยวข้องต่อการดำเนินการเรียกค่าเสียหายเบื้องต้น ของโรงพยาบาลตำรวจ จำนวน 40 คน และแบบสัมภาษณ์กับผู้ประสบภัย ที่มารักษาตัวในโรงพยาบาลตำรวจ ระหว่างวันที่ 15 สิงหาคม - 15 กันยายน 2539 และมอบอำนาจให้โรงพยาบาลตำรวจดำเนินการเรียกค่าเสียหายเบื้องต้นแทนตน เป็นเครื่องมือในการรวบรวมข้อมูล

ผลการศึกษาพบว่า / ระดับประสิทธิผลการเรียกค่าเสียหายเบื้องต้นตามสิทธิ ภายใต้การคุ้มครองของ พ.ร.บ.คุ้มครองผู้ประสบภัยจากรถ ของโรงพยาบาลตำรวจ มีประสิทธิผลอยู่ในระดับปานกลาง ทั้งนี้ จากการศึกษาระหว่างความสัมพันธ์ของตัวแปรต่าง ๆ ที่กำหนดตามกรอบแนวคิดในการศึกษา พบว่า / 1. การประสานงานระหว่างระบบย่อยการรักษาและระบบย่อยการเรียกเก็บค่ารักษา มีความสัมพันธ์กันอย่างมีนัยสำคัญทางสถิติที่ระดับ .05 กับ การติดต่อสื่อสารและการประสานงานของผู้ดำรงตำแหน่ง / 2. ทัศนคติของผู้ดำรงตำแหน่งในระบบย่อยการรักษาและระบบย่อยการเรียกเก็บค่ารักษาที่มีต่อการดำเนินการเรียกเก็บ มีความสัมพันธ์กันอย่างมีนัยสำคัญทางสถิติที่ระดับ .05 กับ ความรู้สึกผูกพันต่อการมีบทบาทเรียกเก็บ การใช้เหตุผลไตร่ตรองเกี่ยวกับการเรียกเก็บ, และแบบของพฤติกรรมในการดำเนินการเรียกเก็บ.

3. ความร่วมมือของระบบย่อยการเรียกเก็บค่ารักษา บริษัทประกันภัยกองทุนทดแทนผู้ประสบภัยที่มีต่อโรงพยาบาลตำรวจ มีความสัมพันธ์กันอย่างมีนัยสำคัญทางสถิติที่ระดับ 0.5 กับการร่วมมือของระบบการเรียกเก็บค่ารักษา บริษัทประกันภัย กองทุนทดแทนผู้ประสบภัย และทัศนคติต่อระบบย่อยการเรียกเก็บค่ารักษา บริษัทประกันภัย กองทุนทดแทนผู้ประสบภัย /จากผลการศึกษา จึงมีข้อเสนอแนะว่า โรงพยาบาลตำรวจ ควรเสริมสร้างความแข็งแกร่งของการประสานงาน และทัศนคติของผู้ดำรงตำแหน่งในระบบย่อยการรักษา และค่ารักษา บริษัทประกันภัย และกองทุนทดแทนผู้ประสบภัยที่มีต่อโรงพยาบาลตำรวจเพื่อให้เกิดการประสานสอดคล้อง สามารถทำงานร่วมกันได้โดยราบรื่น ด้วยการสนับสนุนการติดต่อสื่อสารงานของผู้ดำรงตำแหน่ง ให้มีการประสานสัมพันธ์อย่างแนบแน่นมากยิ่งขึ้น มีทัศนคติที่ดี รู้จักการใช้เหตุผลอย่างไตร่ตรอง อันมีผลต่อบุคลิกภาพ ซึ่งจะนำไปสู่ความสำเร็จในการเรียกเก็บค่าเสียหายเบื้องต้นได้ในที่สุด ด้วยการใข้ระยะเวลาที่สั้นขึ้น โดยได้รับจำนวนเงินที่ครบถ้วน

There are two objectives in initiating this study. Firstly, to look for the effectiveness of The Police General Hospital in claiming initial compensation under the privilege provided by The Protection for Motor Vehicle Accident Victims Act and secondly, to search for guidelines in improving and developing a more effective claim system. / The scope of study has two aspects, documentary and systematic study. The purpose of documentary study is to understand the relationship between various units responsible for the success or failure of the claim. In systematic study, two target groups, mamely 40 of the hospital officials responsible in the claim process and the victims of motors vehicle accident treated during August, 15 to Septmber, 15, 1996 were asked to answer the questionnaires for futher analysis. / The analysis revealed that the effectiveness of the initial compensation claim by the hospital was only moderate. The study of relationship among multiple variables within the scope of study revealed :

1) The coordination between the medical care unit and the medical expense billing unit closely related to the communication and coordination of authorized of authorized persons (p < 0.05) / 2) The attitude of authorized persons toward the claim is significantly related to the feeling of attachment T. the role of claim, the reasoning concerning the claim and the behavioral pattern > of claim processing (p < 0.05) / 3) The cooperation among the medical expense billing unit, insurance companies, the central motor vehicle accident victims fund is significantly related (p < 0.05) to the cooperation and attitude of claim process, insurance companies and the central motor vehicle accident victims fund. All these factors are closely ralated to the efectiveness fo the claim (p < 0.05). However, the attitude of the hospital personnels responsible in the claim process has no relationship to the effectivencess of the claim (p < 0.05)

From this study, lt is suggested that The Police General Hospital needs to strengthen the coordination and attitude adjustment fo the various units involving in the claim process which lead to better cooperation with the insurance companies and the central motor vehicle accident victims fund in order to ensure successful claim in the shortest time.
