Abstract
วิทยานิพนธ์เรื่อง ความรับผิดอาญาในการแพร่เชื้อเอชไอวีโดยเจตนา มีวัตถุประสงค์ เพื่อนำเสนอแนวคิดและนำเสนอความสำคัญของการกำหนดความรับผิดอาญาในการแพร่เชื้อเอชไอวีโดยเจตนา ไม่รวมถึงการแพร่เชื้อเอชไอวีโดยประมาท และไม่รวมถึงความรับผิดทางแพ่งหรือมาตรการทางกฎหมายอื่น ๆ ในการควบคุมการแพร่เชื้อเอชไอวี โดยศึกษาจากกรณีที่เกิดขึ้นในประเทศไทยและต่างประเทศ
จากการศึกษาพบว่า ประเทศไทยไม่มีกฎหมายเฉพาะเพื่อกำหนดความรับผิดอาญาในการแพร่เชื้อเอชไอวีโดยเจตนา เหมือนเช่นในต่างประเทศที่ระบุเป็นความผิดโดยตรงและไม่ได้บัญญัติไว้เป็นฐานความผิดในประมวลกฎหมายอาญา หรือไม่เคยมีการนำประมวลกฎหมายอาญามาปรับใช้ให้การกระทำดังกล่าวเป็นความผิดอาญา
จากการศึกษาเปรียบเทียบกับกรณีการแพร่เชื้อเอชไอวีโดยเจตนาที่เกิดขึ้นในต่างประเทศ พบว่ามีหลายประเทศที่กำหนดให้การกระทำดังกล่าวผู้กระทำจักต้องรับผิดอาญา เช่น รัฐเทสเนสซี่ ประเทศสหรัฐอเมริกา โดยกฎหมายอาญาแห่งรัฐมีบทบัญญัติกำหนดความรับผิดอาญาฐานแพร่เชื้อเอชไอวีไว้โดยเฉพาะ รัฐโอเรกอนและรัฐเมสซาซูเสส ประเทศสหรัฐอเมริกา ไม่มีกฎหมายที่บัญญัติเกี่ยวกับการแพร่เชื้อเอชไอวีโดยเจตนาไว้โดยเฉพาะ อย่างไรก็ตามเมื่อเกิดกรณีการแพร่เชื้อเอชไอวีโดยเจตนา เจ้าหน้าที่รัฐที่เกี่ยวข้องได้นำกฎหมายอาญาของรัฐมาปรับใช้และดำเนินคดีผู้กระทำในข้อหาทำร้ายร่างกายสาหัสและข้อหาพยายามฆ่า ประเทศเยอรมัน ไม่มีกฎหมายที่บัญญัติเกี่ยวกับการแพร่เชื้อเอชไอวีโดยเจตนาไว้โดยเฉพาะเช่นเดียวกัน แต่เมื่อเกิดการกระทำอันมีลักษณะเป็นการแพร่เชื้อเอชไอวีโดยเจตนา ได้มีการดำเนินคดีผู้กระทำในข้อหาทำร้ายร่างกายผู้อื่นให้ได้รับบาดเจ็บสาหัสและข้อหาพยายามก่อให้เกิดอันตรายแก่กายผู้อื่น
ดังนั้นวิทยานิพนธ์นี้ จึงเสนอแนะให้ประเทศไทยนำประมวลกฎหมายอาญาที่บังคับใช้อยู่ในปัจจุบัน ในความผิดเกี่ยวกับชีวิตและร่างกายมาปรับใช้เพื่อลงโทษทางอาญาแก่ผู้แพร่เชื้อเอชไอวีโดยเจตนา ซึ่งเป็นการกระทำที่ก่อให้เกิดอันตรายต่อชีวิตและร่างกายของผู้อื่นอันเป็นการฝ่าฝืนกฎหมายอาญา เช่นเดียวกับรัฐโอเรกอนและรัฐเมสซาซูเสส ประเทศสหรัฐอเมริกา และประเทศเยอรมัน
The thesis’s topic is a criminal offense regarding willful transmission of HIV which has the objective to propose notions and a significance of criminalization of willful transmission of HIV by studying cases occurred in Thailand and foreign countries. This is not including negligent HIV transmission, civil liabilities, and other legal measures which have been used for controlling transmission of HIV. From the study, there are no specific laws to criminalize willful transmission of HIV. This is different from other countries which has criminalized willful transmission of HIV. Also, willful transmission of HIV is not included as an offense in the Criminal Code or not be applied with Criminal law in order to criminalize willful transmission of HIV. From a comparative study, by comparing cases of willful transmission of HIV in foreign countries, the researcher found that there are many countries provide that the person who willfully transmitted HIV shall be punished by Criminal law; for example, in case of Tennessee State in the U.S., the Federal Criminal law contains provisions regarding criminal offense of HIV transmission. For Oregon and Massachusetts State, there is no law in relation to willful HIV transmission; however, when willful transmission of HIV occurred (in these states) officials apply the Federal Criminal Law and prosecute the wrong-doer in the offense of causing the victim to receive grievous bodily harm or attempt to murder another person. Also, in Germany, there is no law specifically related to willful transmission of HIV; however, there are prosecutions against offender for the offense of causing the victim to receive grievous bodily harm or attempt to cause bodily harm to other persons in case of willful transmission of HIV.
