This doctoral thesis, entitled “Guidelines for Amendments to the Law on Public Vehicle Safety”, aims to identify ways to improve public vehicle safety in Thailand. The researcher in this study focused on four important domains: driving licences and public driving licences; driving duration and driving record; component parts and equipment of public transport and concession; and duties and liabilities of public vehicle drivers and operators. By taking into account related concepts, the theories and legal regulations of Thailand ranging from the Vehicle Act, B.E. 2522, the Land Transport Act, B.E. 2522, the Land Transport Act, B.E., Ministerial Notifications, Ministerial Regulations, Rules, Regulations and legal regulations from overseas including European Union Regulations, Turkish and Australian Laws, into account.
This researcher, studied the legal regulations of Thailand including the four aforementioned domains and analyzed these according to relevant theories. The researcher, when comparing these regulations with those enforced in selected countries overseas, noted that the Vehicle Act, B.E. 2522, the Land Transport Act, B.E. 2522, and many other secondary legislations were not adequately addressing road safety issues such as appropriately classifying categories of driving licences and public driving licences, limiting driving time and imposing suitable penalties on drivers and operators that adhered to inferior standards
Therefore, it is recommended that the laws on public vehicle Safety be amended. For example by classifying categories of driving licences to better correspond to certain public driving licences, ensuring stricter and more rigorous driving tests, stating the minimum for the issue of provisional licences, limiting drivers’ driving time, proposing a regulation to carry and use safety equipment and imposing suitable penalties on inferior drivers and operators. The researcher hopes that these suggestions will also be beneficial for secondary legislation enacted under the Land Transport Act, B.E. |
