Abstract: |
The objective of this research aims to study the theory and concept of using electronic monitoring in the juvenile comparison with the criteria of using electronic devices (EM) in the juvenile according to the context of foreign laws which should be implement to the context of Thai Society and to purpose the suitable ways to improve and develop the Thai Legal System to ensure that the use of the electronic monitoring devise with the juvenile is more clearly and effective.
Criminal justice system in Thailand aims to rehabilitating offenders instead of seeking to punish with a retributive purpose that the offenders can be truly transformed from the criminal offenders into a law-abiding citizen. Therefore, an electronic device, which considers an appropriate measure, has been used with a juvenile delinquency in order to eliminate inequality within society, to help solve the problem of crowded juvenile detention center, to avoid the problem of condemning offenders as well as to reduce the government spending in taking care of the offenders in the detention center.
Through the study, it is found that there are 4 countries using this measure. In those countries, it can be divided into two groups; the first is the group of countries which has the specific law on using the electronic monitoring devise with the juvenile, second group is the countries which have not the specific law. Which the first country group being more successful than the second group. There were some advantages; for example, Reduction of crowded detention center, repeat offense and government xpenditure.
Consequently, It is recommended that Thailand should be implement the electronic monitoring device for juveniles in case of a provisional release or after a court judgment. So, these can give as to give an opportunity for the juvenile to come back to the society. |
