Abstract: |
The protection of the Thai geographical indications emphasizes the protection of community rights over the joint use of geographical indications by the persons living in the community whose production of geographical indications is essential. However, the law protecting Thailand's current geographical indications, which is carried out under the agreement that intellectual property rights in trade or travel are prohibited from using the words "kind", "type", "style" or the words that are meant to be similar to these words and that are composed of four geographical indications of only rice, silk, wine, and alcohol. Since they may cause problems for consumers in using such legal loopholes. This may also affect the community's rights to damage the reputation of the legally registered geographical indications of composition. In addition, in the case of community relocation or where non-community individuals use geographical indications as a composite of their products, which could cause confusion in the source and quality of the geographical indications.
This research has focused on the protection of geographical indications from international law, foreign law, and domestic law, which indicate that each law differs in its intention to protect geographical indications. If the legal provisions that are useful for protecting geographical indications from each law are applied to protect Thai geographical indications, they will prevent consumer fraud and confusion at source and the actual quality of the geographical indication of the user may be due to the use of the word "kind", "type", "style" or the words that are meant to be similar to these words to the combination of geographical indications, so if further modification of the criterion of usage of the compound on such a point will help to prevent the future problems well.
According to the results of the study, the company has suggested a Geographical Indication Protection Act for the Year of the Decade of 2003. Ministry regulations on the protection of geographical indications and the Agreement on Trade- Related Aspects of Intellectual Property Rights or TRIPS Agreement that have all eight legal issues. Firstly, the ministry of commerce should increase the standard of classifying geographical indications by type of geographical indication in the ministry's rules. Secondly, the criteria should be increased in the way that permission is requested to use the word “kind", "type", "style" or the words that are meant to be similar to these words with geographical indications in the Ministry's rules. Thirdly, The criteria for allowing the use of the word “kind", "type", "style" or the words that are meant to be similar to these words that shall be added to the geographical indications in the Ministry's rules. Next, It should be added that an outsider or person who has never produced a geographic indication in the same community is not entitled to apply for the word “kind", "type", "style" or the words that are meant to be similar to these words with the geographical indication in the Ministry's rules. Next, the benefit sharing principle should be increased in return for using the word “kind", "type", "style" or the words that are meant to be similar to these words or phrases as geographical indications or similar in cases where the community is relocated under the Geographical Indicative Protection Act, in 2003. Next, the lawsuits against a violation of geographical indications should be increased by using the word “kind", "type", "style" or the words that are meant to be similar to these words in the Geographical Indication Protection Act, in 2003. Next, Thailand should demand that the world trade talks on the Trips Agreement be extended to cover geographical indications other than those specified in Article 23. Finally, Thailand should make trade agreements with its trading partners at international level, without using the word “kind", "type", "style" or the words that are meant to be similar to these words as geographical indications or similar in the trading country. |
