Abstract: |
Medical practice litigation weakens the relationship between patients and practitioners and leads to self-protective medical treatment. That is, more and more thorough pathological examinations were conducted. The consequence is that the costs of health care system increase accordingly.
Studies of judicial process and medical dispute resolution in Thailand address relevant issues, such as causes of errors and potential medical disputes, in order to create an understanding of the medical process that will lead to the study of Thai and foreign laws to be used in the resolution of medical disputes, both by the mainstream and alternative justice processes. The methodology of this research is qualitative by documentary research. Hence, this research studies, gathers and analyzes information from text books, articles from legal and public health journals, as well as primary and secondary information from the internet.
Results of the research indicate that Thailand has attempted to apply the No-fault compensation system from the practice and principles of foreign law to enforce in cases of medical disputes. This is stipulated in Section 41 of The National Health Security Act, B.E. 2545 (A.D. 2002) and Section 63 (7) of The Social Security Act, B.E. 2533 (A.D. 1990). However, the scope of legal enforcement of both legislations cannot equally compensate everyone nationwide. It is also against the true intention of the laws themselves. This research, thus, suggests the following enactment and amendment of the laws. Firstly, specific legislation of The Proposed Act of Patient Compensation for Injury from Medical Practice should be enacted. Secondly, there should be amendment for Section 17 on the objective of Compensation Fund, Section 18 on subsidy of private medical institutions, and Section 19 on rate of contribution to the Fund, as well as other related laws. |
