Abstract
ในปัจจุบันนั้นปัญหาที่เกิดขึ้นในประเทศไทยอย่างหนึ่ง คือ การละเมิดลิขสิทธิ์ในสินค้าที่มีชื่อเสียงและเป็นความต้องการของตลาด ซึ่งส่งผลกระทบเป็นวงกว้าง ต่อระบบเศรษฐกิจ ทำให้เจ้าของลิขสิทธิ์นั้นสูญเสียรายได้และความเชื่อมั่นในการผลิตผลงานต่อไป ซึ่งในสังคมไทยของเรานั้นจะเห็นได้ว่ามีการจำหน่ายสินค้าละเมิดลิขสิทธิ์ในที่ต่างบนเว็บไซต์จนเป็นความเคยชิน ซึ่งทำให้เกิดการศึกษาเรื่อง ความรับผิดทางอาญาของเจ้าของพื้นที่ที่อนุญาตให้มีการจำหน่ายสินค้าละเมิดลิขสิทธิ์บนเว็บไซต์กรณีให้เช่าพื้นที่ ขึ้นโดยมีความมุ่งหมายที่จะศึกษาถึงความจำเป็นที่จะกำหนดความรับผิดของเจ้าของพื้นที่ที่อนุญาตให้มีการจำหน่ายสินค้าละเมิดลิขสิทธิ์บนเว็บไซต์โดยให้เจ้าของพื้นที่บนเว็บไซต์นั้นได้เข้ามามีส่วนร่วมในการที่จะควบคุมและป้องกันสินค้าที่มาจากการละเมิดลิขสิทธิ์ที่มีการปรากฏว่าจำหน่ายอยู่บนเว็บไซต์ของตน
อย่างไรก็ตามเมื่อพิจารณาถึงบทบัญญัติในพระราชบัญญัติลิขสิทธิ์ พ.ศ.2537 ไม่มีบทบัญญัติเกี่ยวกับความรับผิดของเจ้าของพื้นที่ที่อนุญาตให้มีการจำหน่ายสินค้าละเมิดลิขสิทธิ์บนเว็บไซต์อยู่เลย ถึงแม้จะมีนักกฎหมายบางคนจะมีการให้ความเห็นว่าการกระทำดังกล่าวอาจเป็นความรับผิดตามมาตรา 86 กฎหมายอาญาก็ตาม แต่เมื่อพิจารณาจะเห็นได้ว่า ต้องอาศัยการพิสูจน์ถึงหลักเจตนา ซึ่งเป็นหลักที่จะนำมาบังคับใช้แก่กรณีได้เป็นไปได้ยาก
โดยทั้งนี้เมื่อได้ทำการศึกษาถึงแนวคิด ทฤษฎี ตลอดจนคำพิพากษาของศาล และความรับผิดของเจ้าของพื้นที่ที่อนุญาตให้มีการจำหน่ายสินค้าละเมิดลิขสิทธิ์บนเว็บไซต์กรณีให้เช่าพื้นที่ของประเทศสหรัฐอเมริกา จีน และออสเตรเลีย เพื่อวิเคราะห์ความรับผิดของเจ้าของพื้นที่ที่อนุญาตให้มีการจำหน่ายสินค้าละเมิดลิขสิทธิ์อันเนื่องมาจาก ขอบเขตในการให้บริการของเจ้าของพื้นที่บนเว็บไซต์ โดยศึกษาพบว่าประเทศเหล่านั้นมีบทกฎหมายเฉพาะในเรื่องนี้ขึ้น ซึ่งได้กำหนดความรับผิดของเจ้าของพื้นที่ที่อนุญาตให้มีการจำหน่ายสินค้าละเมิดลิขสิทธิ์บนเว็บไซต์ ซึ่งการบัญญัติดังกล่าวก่อให้เกิดทำให้เกิดหน้าที่แก่เจ้าของพื้นที่บนเว็บไซต์ในการตรวจสอบและป้องกันและทำให้เป็นประโยชน์แก่เจ้าของลิขสิทธิ์
ดังนั้นวิทยานิพนธ์เล่มนี้ จึงขอเสนอให้มีการบัญญัติกฎหมายเกี่ยวกับความรับผิดทางอาญาของเจ้าของพื้นที่ที่อนุญาตให้มีการจำหน่ายสินค้าละเมิดลิขสิทธิ์บนเว็บไซต์กรณีให้เช่าพื้นที่ ซึ่งเป็นกฎหมายเฉพาะที่กำหนดความรับผิด โดยเพิ่มขอบเขตความรับผิดของเจ้าของพื้นที่นั้นรู้หรือมีเหตุอันควรรู้ถึงการละเมิดลิขสิทธิ์บนเว็บไซต์ และยังมีการให้ใช้พื้นที่ของตนเพื่อการกระทำของบุคคลอื่นและการกระทำของบุคคลอื่นที่เจ้าของพื้นที่มีอำนาจในการควบคุมและตรวจสอบตลอดจนการได้รับผลประโยชน์ทางการเงิน เพื่อให้กฎหมายมีประสิทธิภาพในการใช้บังคับมากยิ่งขึ้น
Nowadays, one of common problems in Thailand is copyright infringement of well-known and high demand products that has wide impact on economic system. Copyright owners lose their revenue and confidence in potential production. The sales of pirated goods in different sites have been widely and familiarly found. In this regard, the research aimed to study criminal liability of hosting providers allowing the sale of pirated goods on their website. This study focused on investigating the need to determine the liability of hosting providers allowing the sale of pirated goods on their website. Hosting providers shall participate in controlling and protecting copyright infringement and the sale of pirated goods on their own site. However, when provisions of the Copyright Act, B.E. 2537 (1994) are considered, no provisions on the liability of hosting providers allowing the sale of pirated goods on their website is found. Although some lawyers opinioned that such actions may be liable under Section 86 of the criminal law, proof of intent is required and it is difficult to apply proof of intent to the case. When exploring related concepts, theories, judgments of the court and the liability of hosting providers allowing the sale of pirated goods on their website in United States, China and Australia to analyze their liability due to their scope of services, the results indicated as follows. These countries have specific provisions on this regard that stipulate the liability of hosting providers allowing the sale of pirated goods on their website. These provisions lead to the responsibility of hosting providers to control and protect the sale of pirated goods on sites, providing the benefits to copyright owner. Thus, this thesis would suggest the provisions on criminal liability of hosting providers allowing the sale of pirated goods on their website that specifically stipulate the liability by increasing the scope of liability of hosting providers to know and aware of copyright infringement on the site. These hosting providers allow other persons to use of their own site and illegal actions of other persons for financial benefits should be controlled and monitored by hosting providers so that law shall be enforced in more efficient manner.
