Abstract
การวิจัยเรื่อง “กระบวนการสื่อสารเพื่อผลักดันพระราชบัญญัติควบคุมผลิตภัณฑ์ยาสูบ พ.ศ. 2560” มีวัตถุประสงค์ในการวิจัย 3 ข้อ 1. เพื่อศึกษากระบวนการสื่อสารในการสนับสนุนพระราชบัญญัติควบคุมผลิตภัณฑ์ยาสูบ พ.ศ. 2560 2. เพื่อศึกษากระบวนการสื่อสารในการคัดค้านพระราชบัญญัติควบคุมผลิตภัณฑ์ยาสูบ พ.ศ. 2560 และ 3. เพื่อศึกษาผลกระทบของการผลักดันพระราชบัญญัติควบคุมผลิตภัณฑ์ยาสูบ พ.ศ.2560 เป็นงานวิจัยเชิงคุณภาพ (Qualitative research) โดยใช้เครื่องมือในการวิจัย 3 รูปแบบ ประกอบด้วย การวิเคราะห์เนื้อหาเชิงคุณภาพ (Qualitative Content Analysis) ที่ได้จาก การเก็บกฤตภาคข่าวจากหนังสือพิมพ์เชิงคุณภาพและเชิงปริมาณ จำนวน 16 ฉบับ รวม 1,197 ข่าว การวิเคราะห์เอกสาร (Document analysis) ประกอบด้วย สมุดปกขาว รายงานประจำปี วารสาร เว็บไซต์ และ การสัมภาษณ์แบบเจาะลึก (In Depth Interview) แหล่งข้อมูล 3 กลุ่ม ได้แก่ กลุ่มนักวิชาการ 3 แขนง ประกอบด้วย นักวิชาการด้านนิเทศศาสตร์ นักวิชาการด้านกฎหมาย และนักวิชาการด้านเศรษฐศาสตร์ กลุ่มกระทรวงสาธารณสุข และกลุ่มสื่อมวลชน
ผลการวิจัยพบว่า กลุ่มสนับสนุนและกลุ่มคัดค้านใช้กระบวนการสื่อสารในลักษณะใกล้เคียงกัน มีเป้าหมายไปที่ผู้มีอำนาจตัดสินใจทั้ง คณะรัฐมนตรี รัฐบาล สมาชิกสภานิติบัญญัติแห่งชาติ ส่วนแกนของสื่อสาร กลุ่มสนับสนุนมีการสื่อสารแบบบนลงล่างและแบบแนวระนาบ ขณะที่กลุ่มคัดค้านพบการสื่อสารแบบบนลงล่าง เพียงรูปแบบเดียว ระดับของการสื่อสารทั้งสองกลุ่ม พบ การสื่อสารระหว่างบุคคล การสื่อสารกลุ่มเล็ก การสื่อสารองค์กร และการสื่อสารมวลชน โดยพบการสื่อสารสาธารณะเฉพาะกลุ่มคัคค้าน ขณะที่มิติของการสื่อสาร กลุ่มสนับสนุนใช้มิติด้านสุขภาพ กลุ่มคัดค้านใช้มิติด้านเศรษฐกิจและสังคม ประเภทของสื่อที่มีการใช้สื่อ 5 ประเภทเหมือนกัน ได้แก่ สื่อบุคคล สื่อเอกสาร สื่อสิ่งพิมพ์ สื่อมวลชน สื่อเฉพาะกิจ และสื่ออินเตอร์เน็ต
กลยุทธ์การสื่อสารพบว่า กลุ่มสนับสนุนและคัดค้าน ใช้ กลยุทธ์การชี้แนะสาธารณะผ่านสื่อ เป็นกลยุทธ์ที่ใช้สูงสุดลำดับแรกเหมือนกัน และใช้กลยุทธ์อื่น ๆ ร่วม ประกอบด้วย กลยุทธ์การล็อบบี้ กลยุทธ์การประชาสัมพันธ์ กลยุทธ์การออกแบบสาร กลยุทธ์การลดความน่าเชื่อถือ กลยุทธ์การตอบโต้ กลยุทธ์การสื่อสารแบบมีส่วนร่วม กลยุทธ์การสร้างเครือข่ายทางสังคม กลยุทธ์การกำหนดวาระ กลยุทธ์การต่อรอง กลยุทธ์การรณรงค์ โดยมี กลยุทธ์ความรับผิดชอบทางสังคมเป็นกลยุทธ์เดียวที่ใช้เฉพาะกลุ่มคัดค้านเท่านั้น
ขณะที่ผลกระทบที่เกิดจากการผลักดันกฎหมาย พบว่า จากการเปรียบเทียบกฎหมาย 3 ฉบับ มีการเพิ่มตำแหน่งคณะกรรมการผู้ทรงคุณวุฒิด้านการคุ้มครองสิทธิสตรีและสิทธิเด็ก และตัดประเด็นที่เกี่ยวข้องกับธุรกิจ 2 ประเด็น ได้แก่ ประเด็นอำนาจของคณะกรรมการอำนวยการที่มีอำนาจสั่งให้ ผู้ผลิต ผู้นำเข้า และผู้แทนจำหน่ายผลิตภัณฑ์ยาสูบ ส่งเอกสารที่เกี่ยวข้องกับความสัมพันธ์ทางการเงินหรือกิจกรรมระหว่างธุรกิจกับกลุ่มผู้ดำรงตำแหน่งทางการเมือง ข้าราชการ องค์กรต่าง ๆ และประเด็นเกี่ยวกับการติดต่อระหว่างเจ้าหน้าที่ของส่วนราชการกับธุรกิจ
Communication Process in Mobilizing Tobacco Product Control Act B.E.2560 aimed to study Communication Process of support and oppose groups and study the impact of the Tobacco Products Control Act, 2560. This study was a qualitative research using 3 types of research tools consisted of 1) Qualitative content analysis of 1,197 news clippings collection from 16 newspapers, 2) Document analysis performed on white papers, annual reports, website journals and 3) in-depth interviews with 3 Sources of information from Ministry of Public Health, mass media, and academic specialists in mass communications, law, and economics. The research found that support groups and oppose groups use similar communication processes and aim for similar target groups with decision-making power: Cabinet of Ministers, government, and the National Legislative Assembly. The communication axis of support groups are both top-down and horizontal communication, while oppose groups use only top-down communication. The level of communication from both groups is interpersonal, small group communication, corporate communications and mass media. Public communication is used only by oppose groups. In terms of communication dimension, support groups use health dimensions while oppose groups use economic and social dimensions. The types of media used by both groups are the five media types: personal media, print media, mass media, specialized media, and Internet. Regarding communication strategies, the study indicated that media advocacy is strategy that support and oppose groups used the most. Other strategies used consist of Lobbying, Public relationMessage design, Discredit, Retaliation, Participatory Communication, Social networking, Agenda setting, Negotiation, and Campaign. Social responsibility strategy is used only by the oppose groups. The research also found that the impact of legislative action has been strengthened as 3 revised versions of tobacco product control act are compared. While the number of senior members in Women's Rights and Children's Rights Committee was increased, two business issues were excluded from the acts: 1) Executive Board power to command manufacturers, importers and distributors of tobacco products to send evidential documents related to financial relationships or business interactions with political parties, government officials, organizations, and 2) communication details between tobacco businesses and government officials.
