| dc.description.abstract | การศึกษามีวัตถุประสงค์เพื่อ (1) ศึกษาปัญหาของการกำกับดูแลท้องถิ่นไทยที่บังคับใช้อยู่ในปัจจุบัน และ (2)เพื่อศึกษาแสวงหากรอบแนวทางการกำกับดูแลองค์กรปกครองท้องถิ่นคาดว่เหมาะสมกับประเทศไทย โดยวิธีการวิจัยเอกสาร (Documentary Research) การวิเคราะห์และสนทนากลุ่ม (Focus Group Discussion) จากนักวิชาการด้านท้องถิ่น นักวิชาการด้านกฎหมายผู้บริหารท้องถิ่น ข้าราชการท้องถิ่น ผลการศึกษาพบว่า 1) ปัญหาหลักของการกำกับดูแลท้องถิ่นไทยประกอบด้วย (ก) ปัญหาการตีความเรื่องอำนาจหน้าที่ (') ปัญหาการแทรกแซงความเป็นอิสระของท้องถิ่นซึ่งเกิดจากผู้กำกับดูแลและผู้ตรวจสอบของส่วนราชการต่าง ๆ ที่มีหน้าที่ในการกำกับดูแล เช่นสำนักงานตรวจเงินแผ่นดิน คณะกรรมการกฤษฎีกา กรมส่งเสริมการปกครองท้องถิ่น และกระทรวงมหาดไทย ทำให้ท้องถิ่นขาดความเป็นอิสระในการปกครองตนเองตามเจตนารมณ์ของรัฐธรรมนูญและกฎหมายจัดตั้งองค์กรปกครองส่วนท้องถิ่นแต่ละประเภท (2) รูปแบบการกำกับดูแลองค์กรปกครองส่วนท้องถิ่นที่เหมาะสมกับประเทศไทย ควรมีองค์ประกอบที่ชัดเจน 9 ประการ ได้แก่ 1) ด้านบริบทของการกำกับดูแล 2) ด้านหลักการสำคัญของการกำกับดูแล 3) ด้านวัตถุประสงค์และเป้าหมายของระบบกำกับดูแล 4) ด้านประเด็นการกำกับดูแล 5) ต้านโครงสร้างผู้กำกับดูแล 6) ด้านอำนาจในการกำกับดูแล 7) ผู้รับการกำกับดูแล 8) กลไกสำคัญของกระบวนการกำกับดูแล และ 9) ผลของการกำกับดูแล | th |
| dc.description.abstract | The objectives of this research are: (1) to study the consent problems of the intendent rule of the central government over the local government units in Thailand, (2) to find out the appropriate interdenticle model for future management. The qualitative method of study was applied by cases review, key informants interview, and focus group discussion. The two main results of study show that; (1) the lack of national standard guideline for intendants may caused over interfere with local autonomy. (2) The appropriate regulatory elements for local superintendency should be consider; (a) contexts of the intendance (b) the main principles of local self-governance (c) objectives of the intendency system (d) intendency issues (e) intendency structure (f) intendency authorities (g) intendency recipients (h) key mechanisms of the intendency process and (j) result of the intendency system. | th |
