ปัญหาทางกฎหมายเรื่องความยินยอมของผู้บริจาคอวัยวะที่เสียชีวิตจากสมองตายและผู้มีส่วนเกี่ยวข้อง

Abstract

วิทยานิพนธ์เรื่องนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาทางด้านกฎหมายเกี่ยวกับการให้ความยินยอมของผู้บริจาค อวัยวะที่เสียชีวิตและผู้มีส่วนเกี่ยวข้องและมาตรการทางกฎหมายในการควบคุมการปลูกถ่ายอวัยวะในประเทศไทย โดยศึกษาเปรียบเทียบกับแนวทางการปลูกถ่ายอวัยวะขององค์การอนามัยโลก (World Health Organization) หรือ WHO และมาตรการทางกฎหมายของบางประเทศ เช่น สาธารณรัฐสิงคโปร์ สหราชอาณาจักร และสหรัฐอเมริกา เป็นต้น จากการศึกษาพบว่ายังขาดหลักเกณฑ์เริ่มต้นของกฎหมายที่กำนดผู้ที่มีอำนาจขั้นตอนและวิธีการให้ความ ยินยอมในการบริจาคอวัยวะกับกฎหมายการให้ความยินยอมในการบริจาคอวัยวะและกฎหมายที่เกี่ยวข้องกับความผิด และการยกเว้นความผิดทางกฎหมายของบุคลากรทางการแพทย์จากการปลูกถ่ายอวัยวะ ซึ่งหลักกฎหมายบางหลัก เช่น หลักเรื่องความยินยอม หลักความสงบเรียบร้อยและศีลธรรมอันดีของประชาชน หลักเสรีนิยม ก็สามารถที่จะนำมา ปรับใช้ได้ ดังนั้นแล้วการที่ไม่มีกฎหมายเฉพาะเรื่องผู้เขียนจึงได้เสนอให้มีการบัญญัติกฎหมายเฉพาะ เป็นร่างพระราชบัญญัติว่าด้วยการปลูกถ่ายอวัยวะและการบริจาคอวัยวะมนุษย์หลังการตายเพื่อประโยชน์ในการรักษาพยาบาล

Abstract This Thesis aims to study the problems of laws on consent given by the persons who donate the organs after death and relevant persons and legal measures on controlling organ transplantation in Thailand in comparison with the organ transplantation guidelines of World Health Organization (WHO), and legal measures of certain countries; for instance, Republic of Singapore, United Kingdom, and the United States of America. According to the study, there are lack of initial criteria of laws on determining the authorized persons, procedures, and methods of giving consent in donating organs and laws on legal offense exemption of medical personnel from organ transplantation, despite the fact that certain principles of law; for example, principle of consent, principle of public order and good morals, or principle of liberalization can be applied thereto. Therefore, due to no specific law, the researcher proposes providing specific laws as the bills on organ transplantation and human organ donation after death for the benefit of treatment.
