Abstract: |
Thailand has enacted the Digital Asset Business Act B.E. 2561 (2018) to regulate activities and digital asset businesses. The Royal decree came into force on May 14, 2018, and subsequently, The Securities and Exchange Commission has issued 11 announcements. In addition, this law also requires that other relevant laws be applied to activities and digital asset businesses such as Anti-Money Laundering law or Securities and Exchange law etc. Furthermore, for the benefit of control, The Royal decree stipulates penalties for business operators who violate or fail to comply with this law. The penalties include both civil and criminal penalties.
However, although Thailand has specific laws to regulate digital assets but that law still have limitations. This law aim to control only intermediaries and digital asset businesses in Thailand but does not cover the use or transactions without intermediaries and the use of other types of digital assets. For example, using virtual currency, Cryptocurrency Including Bitcoin, has many characteristics, such as using Cryptocurrency as a medium of exchange by exchanging Cryptocurrency with each other or exchanging for goods or services. Or using Cryptocurrency as a currency by exchanging Cryptocurrency for US dollars or Thai baht. From the reasons, this article aimed to explore the laws that apply to digital assets, virtual currency, Cryptocurrency, especially Bitcoin both in Thailand and abroad: Germany, Japan and The United States. Those countries have specific laws to control digital assets, virtual currency, Cryptocurrency Including Bitcoin. The objective is to setting guidelines, regulator and measures. Furthermore, the objective is to improvement Amending the existing laws of Thailand in order to cover the use of digital assets, virtual currency Cryptocurrency and Bitcoin, which are not regulated by specific laws. Therefore, the gap in the law will be reduced. The business, transactions of digital assets, virtual currency, Cryptocurrency Including Bitcoin will be promoted. Activities and digital asset businesses in Thailand will be controlled more efficient and effective. |
