Abstract
ในปัจจุบันคดีอาชญากรรมประเภทคดีข่มขืนกระทำช้ำเราได้มีการพัฒนาที่สลับซับซ้อนทวีความรุนแรงเพิ่มมากขึ้นและไม่จำกัดเพศในการตกเป็นผู้เสียหายในคดีข่มขืนกระทำช้ำเรา ทำให้มีผู้ตกเป็นผู้เสียหายมากขึ้น ผู้ที่ตกเป็นผู้เสียหายในคดีข่มขืนกระทำช้ำเรามีผลต่อผู้เป็นเหยื่อทั้งทางร่างกายและจิตใจ และเมื่อผู้เสียหายไปร้องทุกข์ต่อพนักงานสอบสวน ซึ่งในประเทศไทยนั้นกระบวนการในการสอบสวนของพนักงานสอบสวนโดยวิธีการสอบถามปากคำผู้เสียหายในคดีข่มขืนกระทำช้ำเรานั้นวิธีการในการสอบสวนเหมือนกับการสอบถามปากคำผู้เสียหายในคดีอาชญากรรมทั่ว ๆ ไป ทำให้ผู้เสียหายในคดีข่มขืนกระทำช้ำเรารู้สึกเหมือนตกเป็นเหยื่อซ้ำสอง (Revictimization) ส่งผลต่อความรู้สึกทางจิตใจมากขึ้น ประเทศไทยมีการให้ความคุ้มครองผู้เสียหายในคดีความผิดเกี่ยวกับเพศตามประมวลกฎหมายวิธีพิจารณาความอาญามาตรา 133 ทวิ แต่ในมาตรานั้นให้ความคุ้มครองเฉพาะกรณีที่ผู้เสียหายมีอายุไม่เกินสิบแปดปีในการสอบถามปากคำของพนักงานสอบสวนตามข้อบังคับของกฎหมายจะมีนักจิตวิทยา หรือนักสังคมสงเคราะห์ ร่วมอยู่ในการสอบถามปากคำ แต่ในการสอบถามปากคำผู้เสียหายที่มีอายุสิบแปดปีขึ้นไปในคดีข่มขืนกระทำช้ำเรากลับไม่ได้รับความคุ้มครองให้มีนักจิตวิทยาหรือนักสังคมสงเคราะห์ร่วมอยู่ด้วยในการสอบถามปากคำของพนักงานสอบสวนเพราะถึงแม้ว่าผู้เสียหายในคดีข่มขืนกระทำช้ำเราจะเป็นเพศใดเมื่อเกิดเหตุการณ์เช่นนี้ขึ้นก็ย่อมถือเป็นผู้เสียหายที่มีภาวะจิตใจอ่อนแอ (Yulnerable Victim) ที่ควรได้รับการคุ้มครองที่แตกต่างไปจาก
ผู้เสียหายในคดีอาชญากรรมแบบทั่วไปก็ตามและการแก้ไขในการสอบถามปากคำผู้เสียหายที่มีอายุสิบแปดปีขึ้นไปให้พนักงานสอบสวนสอบถามปากคำผู้เสียหายโดยให้มีนักจิตวิทยาหรือนักสังคมสงเคราะห์ร่วมอยู่ด้วยกับผู้เสียหายในการสอบสวน เพื่อมิให้ผู้เสียหายรู้สึกไม่สบายใจในบางคำถามที่พนักงานสอบสวนได้สอบถามปากคำถึงเหตุการณ์ที่เกิดขึ้นต่อตัวของผู้เสียหาย ด้วยเหตุนี้หากการสอบถามปากคำของพนักงานมีการกระทำที่มิทำให้ผู้เสียหายเกิดความกระทบกระเทือนใจมากขึ้น ก็ทำให้ผู้เสียหายรู้สึกมั่นใจและเข้ามาฟ้องร้องดำเนินคดีต่อผู้กระทำผิดได
Today, rape crime cases have developed in terms of complexity and intensity. In addition, rape victimization now occurred without gender limitation. This left behind a greater number of rape victims who were affected both physically and mentally. When the victims petitioned to inquiry officials which in Thailand, the way an inquiry official handles an investigation process for a rape crime case is to conduct an interrogative inquiry with the victim in the same way it is done to other general crime cases. As a result, this could put the victim in a situation of re victimization which amplified the mental damage. Thailand provides protection for the victims of sex offenses under Section 133 disaccording to Thai Criminal Procedure Code nevertheless, such protection as provisioned in the section only in effect when the victim is under 18 years old. During an interrogative inquiry conducted by an inquiry official, in accordance with the provisions of the law, a psychologist or social worker must be presented however if the inquiring rape victim is 18 years old and over, he/she is not as protected since the law does not require a psychologist or social worker to be presented during an interrogative inquiry session conducted by an inquiry official. Regardless to the gender of the rape victim, the suffering has considerably made the victim mentally vulnerable and thus should be protected differently from the victim of a typical crime. As to making modification to conducting an inquiry to a victim who is 18 years old and over, an inquiry official should require a psychologist or social worker to be presented before proceeding with the inquiry in order to prevent the victim from feeling troubled as some questions from the inquiry official would be regarding the matter directly inflicted on the victim. For this reason, if the action of an inquiry official indeed causes a mental offense against the victim, then the victim can rest assured and take action such as prosecuting the offender.
