Abstract
งานวิจัยฉบับนี้ มีจุดมุ่งหมายเพื่อศึกษาค้นคว้าเฉพาะเรื่องความรับผิดทางกฎหมายของผู้อำนวยความสะดวกเพื่อการท่องเที่ยวเชิงการแพทย์ ในความเสียหายอันเกิดจากการปฏิบัติงาน เชื่อมโยงกับการรับรองมาตรฐานและคุณภาพของธุรกิจเพราะเป็นหลักการที่นำมาสู่การกำหนดขอบเขตความรับผิดทางกฎหมายของผู้อำนวยความสะดวกฯ อย่างสมเหตุสมผล ประกอบกับหน่วยงานที่ต้องรับผิดชอบในการควบคุมและกำกับดูแล โดยศึกษาบทกฎหมายไทยที่บังคับใช้อยู่ในปัจจุบันประกอบกับแนวทางการกำหนดมาตรฐานในการปฏิบัติงานของประเทศสาธารณรัฐเกาหลี และประเทศอิสราเอล เพื่อเสนอแนะแนวทางในการแก้ไขปัญหาเพื่อให้เกิดการคุ้มครองผู้บริโภคได้อย่างเป็นรูปธรรม
จากการศึกษาพบว่า ปัจจุบันประเทศไทยได้เกิดธุรกิจผู้อำนวยความสะดวกฯ เพื่อให้บริการท่องเที่ยวเชิงการแพทย์แก่คนไทย รวมไปถึงการให้บริการนักท่องเที่ยวจากต่างประเทศเข้ามาในประเทศไทย โดยเข้ามาใช้บริการผ่านตัวกลางให้คำแนะนำประสานงาน คือ บริษัททัวร์ที่มีรายการส่งเสริมการขายหรือแพ็กเกจทัวร์ท่องเที่ยวทางการแพทย์ อย่างไรก็ตาม เมื่อพิจารณาถึงเงื่อนไข การให้บริการของธุรกิจดังกล่าวจะพบว่ามีลักษณะของการให้บริการทั้งในเชิงการท่องเที่ยวรวมกับการให้บริการคำแนะนำทางการแพทย์ ซึ่งเป็นเรื่องละเอียดอ่อนและเฉพาะทางที่จำเป็นต้องมีการกำหนดมาตรฐานในการปฏิบัติงานเข้ามาประกอบการดำเนินธุรกิจด้วย แต่กรอบของกฎหมายในการประกอบธุรกิจดังกล่าวนั้นยังเป็นการเปิดประกอบกิจการเป็นบริษัททัวร์ท่องเที่ยว ตามพระราชบัญญัติธุรกิจนำเที่ยวและมัคคุเทศก์ พ.ศ.2551 อีกทั้ง ยังไม่มีกฎหมายกำกับดูแลในเรื่องของมาตรฐานในการปฏิบัติงาน และการกำหนดสถานะความรับผิดทางสัญญาและละเมิดอย่างชัดเจน
ดังนั้น เพื่อให้เกิดกระบวนการปฏิบัติงานอย่างมืออาชีพ และคุ้มครองผู้ใช้บริการให้สามารถใช้สิทธิเรียกร้องจากการใช้บริการที่ไม่ได้มาตรฐานในการปฏิบัติงานของผู้อำนวยความสะดวกเพื่อ การท่องเที่ยวเชิงการแพทย์ จึงเห็นสมควรดำเนินการปรับปรุงกฎหมายในการกำกับดูแลกิจการทัวร์ท่องเที่ยวเพื่อสุขภาพให้มีมิติทั้งทางด้านการให้บริการที่มีคุณภาพและคำนึงถึงความปลอดภัยในชีวิต ร่างกาย อนามัย และจิตใจของลูกค้าเป็นสำคัญ
This research aims to study legal liabilities of Medical Tourism Facilitator from damage caused by unqualified operations to the customers and analyze qualifications and qualities of such business to create legal standards for business operations and scope legal liabilities and supervised agency for such business. By studying relevant laws and regulations currently enacted in Thailand and overseas countries such as Republic of Korea and State of Israel to provide suggestions on how to protect foreign customers who use Medical Tourism Facilitator services in Thailand and to establish legal measures for ensuring international quality and standard of such business and create reputations as a highly qualified medical hub country. From relevant studies show that Medical Tourism Facilitator rapidly emerging with large numbers in Thailand, offer services both to Thai citizens who seek medical attention in overseas countries and foreigner who coming to Thailand with purpose of receiving Thai medical services both present and alternative medicine as a medical hub of the region. Patients using tour guide operation services company whose offer medical facilitation services. However, considering the conditions of service for such businesses are found to have characteristics of both services, including tourism and medical advice. This is a sensitive and specific and required legal framework to cover business operational which is currently limited. Such as Tourism Business and Guide Act, B.E.2551 (2008) does not have a legal supervision in matters of operational standards and contractual liability and breach status. Therefore, law and regulations concerning legal liabilities of Medical Tourism Facilitator should be adopted in Thailand to achieve a professionally operating processes and protect customers to be able to claim damages from the use of unqualified operation of such business.
