ปัญหาการคุ้มครองดูแลผู้สูงอายุในกฎหมายไทย : ศึกษากรณีหน่วยบริการหรือศูนย์ในการดูแลสุขภาพของผู้สูงอายุตามกฎหมายหลักประกันสุขภาพแห่งชาติ

Abstract

วิทยานิพนธ์ปัญหาการคุ้มครองดูแลผู้สูงอายุในกฎหมายไทย ศึกษากรณีหน่วยบริการหรือศูนย์ในการดูแลสุขภาพของผู้สูงอายุตามกฎหมายหลักประกันสุขภาพแห่งชาติ ฉบับนี้ มีวัตถุประสงค์เพื่อศึกษาความหมาย แนวคิด ทฤษฎีเกี่ยวกับผู้สูงอายุ การคุ้มครองดูแลสุขภาพและการจัดสวัสดิการสำหรับผู้สูงอายุ โดยศึกษาเปรียบเทียบกฎหมายเกี่ยวกับการคุ้มครองดูแลสุขภาพและการจัดสวัสดิการสำหรับผู้สูงอายุทั้งของประเทศไทยและต่างประเทศ เพื่อนำมาวิเคราะห์ถึงปัญหาในการดูแลสุขภาพผู้สูงอายุขององค์กรปกครองส่วนท้องถิ่นและความเชื่อมโยงสัมพันธ์กับหน่วยงานภาครัฐส่วนอื่น รวมไปถึงการศึกษารูปแบบที่เหมาะสมกับการดูแลระยะยาวสำหรับผู้สูงอายุที่อยู่ในภาวะพึ่งพิงเพื่อนำมาปรับประยุกต์ใช้กับสังคมไทย จากการศึกษาได้ค้นพบปัญหาทั้งระดับนโยบาย ข้อจำกัดของกฎหมายหรือระเบียบที่เกี่ยวข้องหลายประการที่กระทบถึงสิทธิขั้นพื้นฐานของผู้สูงอายุที่อยู่ในภาวะพึ่งพิง อันนำมาสู่ข้อเสนอแนะในการปรับปรุงระดับนโยบาย และแก้ไข เพิ่มเติมกฎหมายเกี่ยวกับการคุ้มครองดูแลสุขภาพของผู้สูงอายุในชุมชนให้เหมาะสมกับเหตุการณ์และสภาวะสังคมที่เปลี่ยนแปลงไป เพื่อรองรับการเข้าสู่สังคมผู้สูงอายุอย่างสมบูรณ์ในระยะเวลาอันใกล้นี้

This dissertation aims to study definitions, concepts, and theories on healthcare and welfare arrangements for elderly people in Thailand. Through a comparative legal study of Thailand’s geriatric healthcare laws with countries that are well-known for their health and welfare system, this research’s objectives are to analyze Thai local governments and other relevant organizations’ challenges and shortcomings in elderly care provisions, to evaluate relationships and connections among local agencies and other relevant state agencies, and to study various long-term care models for elders in dependency stage in order to apply such models within the contexts of Thai society. This study’s findings reveal several issues and limitations in relevant Thai policies, laws, and government regulations that ultimately undermine Thai aged population’s fundamental rights. This study’s findings lead to policy-level recommendations and amendments of related law to provide elderly care and protection that are appropriate to shifting social conditions so that Thailand can be prepared to become a fully-aged society in the future.
