Abstract
ดุษฎีนิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาทางกฎหมายเกี่ยวกับสัญญาการแช่แข็งร่างเพื่อรอรับการรักษาด้วยวิทยาการและเทคโนโลยีในอนาคต (Cryopreservation Contract) โดยศึกษาวิวัฒนาการข้อความคิดทั่วไปเกี่ยวกับการแช่แข็งร่างด้วยเทคโนโลยีไครโอนิกส์ (Cryonics) หลักการทั่วไปทางนิติกรรมสัญญา หลักการทางสัญญาสิทธิทฤษฎีและแนวคิดภายใต้หลักการเข้าสู่กระบวนการทางสัญญาการแช่แข็งร่าง พร้อมทั้งวิเคราะห์ปัญหาทางกฎหมายเกี่ยวกับสัญญาการแช่แข็งร่างเพื่อรอรับการรักษาด้วยวิทยาการและเทคโนโลยีในอนาคตในประเด็นปัญหาแนวคิดทางจริยธรรม ศาสนา ศีลธรรม และนิติปรัชญา ปัญหาทางกฎหมายเกี่ยวกับสถานะทางกฎหมายของร่างและความเป็นผู้ทรงสิทธิ ปัญหาความสมบูรณ์ของสัญญาการแช่แข็งร่างด้วยเทคโนโลยีไครโอนิกส์จากหลักการทั่วไปทางสัญญาเกี่ยวกับประเด็นผู้ทรงสิทธิ ความสามารถของผู้ทรงสิทธิกรณีผู้เยาว์ การกำหนดแบบ และวัตถุประสงค์ของสัญญา และปัญหาการขาดหน่วยงานกำกับดูแลและการขาดอำนาจในการควบคุมการประกอบธุรกิจการแช่แข็งร่าง ทั้งนี้ ผู้เขียนศึกษาแนวทางขององค์การอนามัยโลกตลอดจนศึกษาวิเคราะห์เปรียบเทียบแนวคิดการรับรองและแนวปฏิบัติของประเทศสหรัฐอเมริกา ประเทศอังกฤษ ประเทศแคนาดา กับประเทศไทย เพื่อให้ได้แนวทางที่เหมาะสมในการกำกับดูแลธุรกิจการแช่แข็งร่างและการพัฒนากลไกทางกฎหมายที่เกี่ยวข้องนำมาซึ่งมาตรการที่ดีสำหรับสัญญาการแช่แข็งร่างในประเทศไทย
เมื่อทำการศึกษาพบว่า กฎหมายไทยขาดหลักเกณฑ์การกำหนดความเป็นผู้ทรงสิทธิ ไม่มีหลักเกณฑ์เฉพาะที่ใช้บังคับแก่รูปแบบและวิธีการทำสัญญาการแช่แข็งร่าง ผลทางกฎหมายบางประการในกรณีที่การชําระหนี้ตามสัญญาการแช่แข็งร่างกลายเป็นพ้นวิสัยในภายหลัง และการเลิกสัญญาการแช่แข็งร่าง นอกจากนี้ไม่ปรากฏบทบัญญัติพิเศษเกี่ยวกับหน่วยงานกำกับดูแลการประกอบธุรกิจแช่แข็งร่าง อย่างไรก็ตาม หลักกฎหมายบางหลัก เช่น หลักอิสระในทางแพ่ง หลักเสรีภาพในการทำสัญญา หลักความศักดิ์สิทธิ์ของการแสดงเจตนา หลักเสรีนิยม และหลักความสงบเรียบร้อยและศีลธรรมอันดีของประชาชน ยังสามารถนำมาปรับใช้ได้
เนื่องจากเป็นเรื่องใหม่จึงยังไม่มีกฎหมายเฉพาะบังคับใช้ในประเทศไทย ผู้เขียนเสนอให้มีการบัญญัติกฎหมายเฉพาะเป็น “พระราชบัญญัติว่าด้วยการแช่แข็งร่างเพื่อรอรับการรักษาด้วยวิทยาการและเทคโนโลยีในอนาคต” และเสนอแนะทางเลือกในการจัดหาเงินทุนในรูปแบบประกันชีวิตและการบริหารจัดการทรัพย์สินในรูปแบบทรัสต์ ทั้งนี้ ผู้เขียนได้เสนอแนะแนวทางในการจัดหาเงินทุนเพื่อการแช่แข็งร่างในรูปแบบของประกันชีวิตและวิธีการบริหารจัดการทรัพย์สินในรูปแบบของกองทรัสต์ไว้พอสังเขป
This thesis is intended to provide a thorough study of legal problems on cryopreservation agreements i.e. agreements for freezing human remains for medical treatment by future advancement and technology. For these purposes, it seeks to provide analysis of fundamental principles of contract law insofar as they are concerned with issues arising from a cryopreservation agreement including the issues as regards the holding of rights under a cryopreservation agreement, legal capacity of a right holder who is a minor, the determination of a legal form for a cryopreservation agreement and objects of a cryopreservation agreement. In addition, it discusses an appropriate direction for the regulation of cryopreservation business as well as the development of a relevant legal framework with a view to achieving desirable measures for cryopreservation agreements in Thailand, given that all these are new issues currently devoid of specific legislation in this country. In this connection, the study embraces approaches put in place by the World Health Organisation (WHO) bearing close relevance to these matters, with analytical comparison with thoughts and practices reflected in the laws of foreign jurisdictions, consisting of the laws of the United States of America, the United Kingdom and Canada. All these foreign elements are compared with the positions in Thailand. The analytical study reveals that Thai law makes no provisions for the determination of right holders and there exists no rules specifically applicable to forms of and procedures for making a cryopreservation agreement, certain legal effects flowing from subsequent impossibility of a cryopreservation agreement and, finally, termination of a cryopreservation agreement. Also, there has been no specific provision as regards mechanisms for and a body in charge of the regulation of cryopreservation business. Despite such inadequacies, certain legal principles can, nevertheless, be called into play. These include the private autonomy principle, the freedom of contract principle, the autonomy of will principle, the autonomy principle and the principle as regards public order or good morals. The dearth of specific law on these matters leads to the researcher’s proposal that specific legislation be enacted as the “Act on Cryopreservation Agreements for Medical Treatment by Future Advancement and Technology”. It is also recommended that property management through the establishment of trust or the insurance arrangement should be introduced, as alternatives, in facilitation of cryopreservation contracts.
