กรอบความตกลงอาเซียนว่าด้วยการคุ้มครองภูมิปัญญาท้องถิ่น

Abstract

ภายใต้ยุทธศาสตร์การเป็นประชาคมเศรษฐกิจอาเซียน (ASEAN Economics Community: AEC) ประกอบกับเหตุผลและความจำเป็นที่ประชาคมอาเซียนจะต้องมีการคุ้มครองและส่งเสริมการใช้ประโยชน์จากภูมิปัญญาท้องถิ่นในภูมิภาค ภูมิปัญญาท้องถิ่นถือได้ว่าเป็นสิ่งที่สำคัญและจะมีบทบาทต่อการเสริมสร้างระบบทรัพย์สินทางปัญญาของอาเซียน รัฐสมาชิกอาเซียนซึ่งเป็นภูมิภาคที่เป็นแหล่งภูมิปัญญาท้องถิ่นจึงจำเป็นจะต้องมีมาตรการคุ้มครองภูมิปัญญาท้องถิ่นตามที่ปรากฏในพิมพ์เขียวประชาคมเศรษฐกิจอาเซียน พ.ศ. 2568 (ASEAN Economic Community Blueprint 2025) และแผนปฏิบัติการทางด้านทรัพย์สินทางปัญญาของอาเซียน พ.ศ. 2559-2568 (ASEAN Intellectual Property Rights Action Plan 2016-2025) อย่างไรก็ตาม ในแต่ละรัฐสมาชิกอาเซียนต่างก็มีมาตรการทางกฎหมายในการคุ้มครองภูมิปัญญาท้องถิ่นในรูปแบบที่แตกต่างกันไป ซึ่งความแตกต่างดังกล่าวเป็นอุปสรรคต่อการส่งเสริมการใช้ประโยชน์จากภูมิปัญญาท้องถิ่นและการกำหนดมาตรการทางกฎหมายเพื่อคุ้มครองภูมิปัญญาท้องถิ่นในระดับภูมิภาคให้เป็นไปในทิศทางเดียวกัน ดังนั้นการศึกษานี้จึงมีวัตถุประสงค์เพื่อศึกษาความหมาย ลักษณะ และประเภทของภูมิปัญญาท้องถิ่น หลักการ แนวคิด ทฤษฎี รวมถึงข้อสนับสนุนและข้อโต้แย้งที่เกี่ยวข้องกับการคุ้มภูมิปัญญาท้องถิ่น โดยอาศัยความคิดจากแนวคิดด้านสิทธิชุมชุน แนวคิดผลประโยชน์ทางเศรษฐกิจ แนวคิดการรวมตัวในระดับภูมิภาค หลักการคุ้มครองภูมิปัญญาท้องถิ่นในกฎหมายระหว่างประเทศ และกฎหมายต่างประเทศซึ่งมีรูปแบบการคุ้มครองภูมิปัญญาท้องถิ่นในระดับภูมิภาค ได้แก่ สหภาพแอฟริกาและสหภาพยุโรป เพื่อนำผลการศึกษาที่ได้มาเป็นฐานในการวิเคราะห์และสังเคราะห์กระบวนยกร่างความตกลงอาเซียนว่าด้วยการคุ้มครองภูมิปัญญาท้องถิ่นให้เกิดขึ้นในระดับภูมิภาค

According to the ASEAN Economics Community (AEC) strategies, Traditional Knowledge (TK) is significant role for ASEAN community which supports Intellectual Property system of ASEAN community. It is necessary for all ASEAN member countries, which are the sources of TK, to develop the measure of protection through ASEAN Economic Community Blueprint 2025 and ASEAN Intellectual Property Rights Action Plan 2016-2025. However, each ASEAN member countries possess different legal measures for TK protection. The differences become the problems toward promoting the TK utilization, and generating the legal measures for TK protection. Therefore, this study aims to research the definition, the characteristics, and the distinct areas of TK, in addition to principles, concepts, theories, including discussion and arguments on the TK protection issues. The study is conducted through the concepts of community rights, benefit sharing, regional integration as well as the principle of TK protection within international laws and the foreign laws which cover the regional TK protection such as the laws of African Union and European Union. The results of the study are drawn into the analysis and the synthesis of the drafting process of the ASEAN agreement for regional TK protection.
