| dc.description.abstract | “กู๊ดวิลล์” เป็นสินทรัพย์ที่ไม่มีตัวตนชนิดหนึ่งที่สามารถประเมินมูลค่าได้ หากเครื่องหมายการค้าใดมีกู๊ดวิลล์มีคุณค่ามากยิ่งขึ้น รวมไปถึงสินค้าหรือบริการภายใต้เครื่องหมายการค้านั้นก็จะมีมูลค่าที่สูงขึ้นด้วย โดยการคุ้มครองเครื่องหมายการค้าการการละเมิดในประเทศไทยในปัจจุบัน เป็นไปตามพระราชบัญญัติเครื่องหมายการค้า พ.ศ.2534 อันประกอบไปด้วย มาตรา 108 “ห้ามมิให้บุคคลใดปลอมเครื่องหมายการค้าของบุคคลอื่นที่ได้จดทะเบียนแล้วในราชอาณาจักร” และ มาตรา 109 “ห้ามมิให้บุคคลใดเลียนเครื่องหมายการค้าของบุคคลอื่นที่ได้จดทะเบียนแล้วในราชอาณาจักร เพื่อให้ประชาชนหลงเชื่อว่าเป็นเครื่องหมายการค้าของบุคคลอื่นนั้น” อย่างไรก็ตาม จากการศึกษาพบว่าบทบัญญัติดังกล่าวนั้น ยังไม่ครอบคลุมถึงการคุ้มครอง กู๊ดวิลล์ในเครื่องหมายการค้าจากการถูกละเมิดซึ่งอาจจะแตกต่างกับการละเมิดเครื่องหมายการค้าในกรณีปกติ อีกทั้งยังไม่มีปรากฏว่ามีกฎหมายฉบับใด ๆ ในประเทศไทยกำหนดคำนิยามทางกฎหมายของคำว่า “กู๊ดวิลล์” ไว้แต่ประการใด ดังนั้น จึงเกิดปัญหาในความชัดเจนเกี่ยวกับความคุ้มครองกู๊ดวิลล์จากการละเมิดชื่อเสียงในเครื่องหมายการค้า ทำให้เครื่องหมายการค้าที่มีกู๊ดวิลล์ไม่ได้รับความคุ้มครองตามกฎหมายเท่าที่ควร ดังนั้น จึงควรปรับปรุงบทบัญญัติในเรื่องการคุ้มครองเครื่องหมายการค้าจากการถูกละเมิดตามพระราชบัญญัติเครื่องหมายการค้า พ.ศ.2534 ให้ครอบคลุมถึงการละเมิดต่อกู๊ดวิลล์ในเครื่องหมายการค้าด้วย โดยนำบทบัญญัติแห่งกฎหมายเครื่องหมายการค้าแห่งประเทศสหรัฐอเมริกา ประเทศแคนาดา สหภาพยุโรป และกฎหมายระหว่างประเทศ ได้แก่ อนุสัญญาปารีสว่าด้วยการคุ้มครองทรัพย์สินอุตสาหกรรม (Paris Convention) และ ความตกลงว่าด้วยทรัพย์สินทางปัญญา (TRIPS Agreement) ซึ่งมีความชัดเจนและเหมาะสมในการนำมาเป็นต้นแบบของการคุ้มครองกู๊ดวิลล์ในเครื่องหมายการค้าจากการถูกละเมิด | th |
| dc.description.abstract | “Goodwill” is an intangible asset that can be evaluated. When trademark have a goodwill, these trademark including goods or services under trademark will be more value added. Currently, the legal measure for protecting trademark in Thailand has been regulated in Trademark Act B.E.2534 Section 108 as “Any person shall not counterfeit a trademark registered in Thailand by another person” and Section 109 as “Any person shall not imitate a trademark registered in the Kingdom by another person in order to mislead the public into believing that it is the trademark of such other person.” However, this study has shown that these legal measures are not covering to protect the goodwill from trademark dilution that may different with trademark infringements case. Furthermore, there have no the legal definition of “Goodwill” in the law of Thailand. So, it was a problem to be clear about the protection of goodwill from trademark dilution and made a goodwill of trademark is not protected by the law enough. Therefore, the legal measure for protecting trademark in Trademark Act B.E.2534 should be an improvement to cover the case of trademark dilution. This should be carry out by using the Trademark law of USA, Canada, and EU, including international law as Paris Convention and TRIPs Agreement to be the models which are clear and appropriate. | th |
