Abstract: |
Thailand is facing the change of demographic structure to aging society as evidenced by the continuously rising number of senior citizens. Because of this change, the proportion of aging population is growing while the number of the labor forces is reducing quickly. The problem of the shortage of labor forces has become the important issue which indirectly affects the economic growth of the country. Consequently, the Thai labor market has to recruit more aging workers to the market. The issues concerning the working of older workers, therefore, unavoidably, are rising and will have an effect to the country in the near future.
Although the Thai government has determined the policies to promote hiring older workers, still, the issues concerning the working of older workers are increasing, especially the legal protection rights regarding hiring conditions and working conditions. These are problems that Thai government need to be aware of and be prepared to define the measure to support and solve such issues. As older workers have many limitations, especially the health conditions, it is necessary to establish the measure to protect the working of older workers appropriately.
Consequently, this thesis’s purpose is to study the Labor Protection Act B.E. 2541 concerning the protection of the working of older workers in 3 issues. First, it is the number of working hours. The general rule of number of working hours for labor forces has been specified for 8 hours. However, the older workers whose health tend to be weaker than younger workers should work less than 8 hours. Second, it is the type of jobs. The labor forces can work for any jobs that are allowed by the law. Thus, the older workers who want to continue working can pursue their works that they are capable of and agreed by both employers and them under the conditions, qualifications, health conditions, and capabilities of the employees. Lastly, it is the compensation. In general, the government has determined the minimum wage of labor forces. However, the older workers mostly have better experience and expertise despite of health limitation than the younger workers. The compensation for older workers, hence, should be higher than the younger workers.
Those three categories are key factors that need to be indicated in a measure to protect older workers and to help them continue working after their retirement. The fair measure can help the older workers earn money for living with their capabilities and pride. Further, the older workers can be a part to contribute their capabilities and expertise to help growing the economy of the country as well. |
