Abstract
วิทยานิพนธ์ฉบับนี้มุ่งศึกษาถึงการรับรองสิทธินัดหยุดงานตามมาตรฐานแรงงานระหว่าง
ประเทศและกฎหมายของสาธารณรัฐฝรั่งเศส ภายใต้แนวคิดเกี่ยวกับหลักสิทธิและเสรีภาพ หลักการเจรจาต่อรอง หลักความต่อเนื่องของการจัดทำบริการสาธารณะ เพื่อพิเคราะห์การรับรองสิทธินัดหยุดงานในกิจการสาธารณูปโภคตามกฎหมายว่าด้วยแรงงานรัฐวิสาหกิจสัมพันธ์ของประเทศไทย โดยทำการศึกษาในเชิงคุณภาพบนเอกสารทางวิชาการอันประกอบด้วยหนังสือ วารสาร บทความ วิทยานิพนธ์ รายงานการวิจัย กฎหมายภายในประเทศและกฎหมายของต่างประเทศผลการศึกษาพบว่า กฎหมายว่าด้วยแรงงานรัฐวิสาหกิจสัมพันธ์ฉบับปัจจุบัน มีบทบัญญัติห้ามมิให้พนักงานรัฐวิสาหกิจทุกแห่งนัดหยุดงานโดยเด็ดขาด โดยมิได้คำนึงถึงวัตถุประสงค์ในการจัดตั้งรัฐวิสาหกิจของประเทศไทยในแต่ละแห่งว่ามีภารกิจในการดำเนินการเพื่อให้บริการสาธารณะหรือไม่ นับว่าเป็นกฎหมายที่จำกัดสิทธิเสรีภาพของลูกจ้างไว้เกินสมควร ซึ่งไม่สอดคล้องกับหลักการพื้นฐานตามมาตรฐานแรงงานระหว่างประเทศที่ได้วางหลักเกณฑ์ในการจำกัดสิทธินัดหยุดงานของ
ลูกจ้างไว้ว่าสามารถกระทำได้เพียงเท่าที่จำเป็นเพื่อการรักษาไว้ซึ่งประโยชน์สาธารณะเท่านั้น และไม่ถือว่าขัดต่อหลักเสรีภาพในการรวมตัวเป็นสหภาพแรงงาน โดยให้พิจารณาจากประเภทของบริการสาธารณะที่มีความจำเป็นต่อชีวิต ความปลอดภัย และสุขอนามัยของประชาชนเป็นประการสำคัญแนวทางการแก้ไขปัญหาดังกล่าวสามารถกระทำได้โดยการนำความเห็นของคณะกรรมการว่าด้วยเสรีภาพในการสมาคมขององค์การแรงงานระหว่างประเทศมาเพื่อเป็นหลักเกณฑ์ในการพิจารณารับรองสิทธินัดหยุดงานให้แก่แรงงานในรัฐวิสาหกิจ และเพื่อบรรเทาความเดือดร้อนที่อาจจะเกิดขึ้น
แก่สาธารณะชน ควรนำมาตรการทดแทนการใช้สิทธินัดหยุดงานตามกฎหมายของสาธารณรัฐฝรั่งเศสมาเป็นแนวทางในการแก้ไขปรับปรุงกฎหมายว่าด้วยแรงงานรัฐวิสาหกิจสัมพันธ์ให้มีความเหมาะสมกับบริบททางเศรษฐกิจ สังคม และวัฒนธรรมของประเทศไทย รวมทั้งเพื่อให้เกิดความสอดคล้องกับมาตรฐานแรงงานสากลต่อไป
The purpose of this thesis had studied about the acceptation of the right to in the public services according to the International Labour Standardization and the Republic of France Law under the concept of human rights and freedom, the concept of negotiation, the continuity of public services for the acceptation of the right to strike the Labour Law under the state enterprise labour relations Act B.E. 2543 (2000). This research study is a qualitative analysis under the documentary research from the various sources such as books, journals, information items and websites from both Thai law and International Labour laws etc. This study result findings that the Labour law in public-government relation Act B.E. 2543 (2000)at present having the Code Act.of prohibition of the right to strike confidently in all kinds of the public-government relations intersection by not awareness of the purpose on objective of establishment in Thailand. In each sector having the importance proceduring level in public services differently. This law is giving over limitation to the basic of employee in labour right. It is not matching with the basic rights of employees labour according to the international labour standardization which gives rise to the concept of the limitation of the right to strike of employees by giving the concept of performance ability of need to protect the public services benefits and it is considering as non-violence to the individual right by considering from the types and kinds of public services for the need of life, safety and the population health to be consider as the most importance. The correction in these problems are able to doing according to the opinions and concept of the freedom committee in the international Labour Organization society for maintaining the standard in considering the acceptance of thee right to strike for the state labour enterprise labour relations intersection to reduces the public problems by using the standard rules for replacement in the right to strike according to the republic of France Labour Law for the correction and law reform in the public-government intersections relations law. It is give rises to the balancing and properly which is depends upon the economics, social and Thai cultural to be matching with the international labour standardization.
