Abstract: |
Currently, copyright laws has been enforced to protect creative works in the digital context according to the Copyright Act B.E. 2537 and amended. The amended law provides copyright protection according the context of digital technology development. Nevertheless, due to the mentioned amended regulation, the public interest is impacted by the inability of access or use such works although users apply to the exception of copyright infringement. Especially, Fair Use Doctrine which is able to create equilibrium between public Interest and copyright holder in digital era is also significantly affected. Therefore, the countries with developing economies (Content User’s Countries) lost opportunity in accessing and copying works created by the countries with developed economies (Content User’s Countries)
The objective of this study is to comparatively analyze and discuss legal issues concerning the importance and impact of copyright protection in the digital age. The comparative analysis of copyright protection was made between the countries with developing economies and the countries with developed economies on the issue of Technological Protection Measures (TPMs), Rights Management Information (RMI). The impact on the public interest is also presented to analyze the equilibrium of benefits in enforcing copyright laws in the digital era between the laws of the countries with developing economies and developing economies the countries. The research also offers useful guidelines for determining the scope and criteria for protecting copyrighted works in the digital era of Thailand by using legal and non-legal measures.
From a comparative analysis, it found that Technological Protection Measures prohibit the exploitation of copyrighted works in the digital era and hinder the Fair Use Doctrine, resulting in the public being deprived of access control technology regardless that the exploitation of the user's copyrighted work may be within the scope of use for personal, educational purposes. This consequence also includes the accessibility and utilization of orphan work, and the impact of Technological Protection Measures on public domain creations. In addition, the issues to be taken into account are the inability to change the information that identifies the author although a copy of the copyrighted work is obtained properly and legally due to the Protection of Rights Management Information provisions. This affects the use of copyrighted works for personal gain (Private Use), as well as the enforcement of the principle Exhaustion of Rights which cannot be applied to copyrighted works in digital form.
The author therefore recommends a solution by requiring that in the case of the law in relation to the rights management information, the exceptions of breaches should be applied in cases where information is lawfully altered for non-profit purposes and for personal gain. Moreover, in terms of Technological Protection Measures, the author recommend remedial action by requiring exemptions of liability if it circumvents technological measures taken by individual teachers or instructors that are not intended for profit. In addition, the exceptions of breach for the benefit of people with disabilities should be defined more clearly. Importantly, there should be a manual for defining the characteristics of effective Technological Protection Measures that deserve legal protection from circumvention. This is for clarity in legal enforcement and to maintain equilibrium of public interest with rights of copyright holders in the digital age. |
